The Department of Transportation, Bureau of Driver Licensing (Department) appeals an order of the Court of Common Pleas of Montgomery County (trial court), wherein the trial court sustained Betsy Ellen Moss (Moss) appeal of a one-year suspension of her operating privileges imposed by the Department pursuant to Section 1547 of the Vehicle Code (Code), 75 Pa.C.S. ? 1547, for refusing to submit to chemical testing after her arrest for driving under the influence of a controlled substance. We reverse.
