The case raises the issue of the sufficiency of the evidence where a defendant has been found guilty of unauthorized use of a motor vehicle and receiving stolen property. Christopher Carson was tried and convicted in a non-jury trial of receiving stolen property and unauthorized use of a motor vehicle. Subsequently the trial court found that the evidence was insufficient to support the verdict and granted a motion to arrest judgment, discharging the defendant. The Commonwealth appeals. We reverse.
